The Big Squeeze: Calif. Weight Loss Clinics Under Investigation

1329899316 90 The Big Squeeze: Calif. Weight Loss Clinics Under Investigation

AUDIE CORNISH, HOST:

In Southern California, a group of weight-loss clinics is under fire for an aggressive ad campaign and the death of five patients. The 1-800-GET-THIN campaign and its affiliated surgical centers are being investigated by local, state and federal agencies.

And as NPR’s Carrie Kahn reports, Congress is getting involved, too.

CARRIE KAHN, BYLINE: If you travel Los Angeles freeways you’ve undoubtedly seen the billboards advertising the weight loss Lap-Band device. Or you’ve heard the group’s catchy ad jingle, even available for your phone’s ringtone.

(SOUNDBITE OF COMMERCIAL)

UNIDENTIFIED WOMAN: (Singing) Let your new life begin. Call 1-800-GET-THIN.

KAHN: The ubiquitous ad campaign and the surgeons affiliated with it are under intense scrutiny. At least three wrongful death lawsuits have been filed, and the Los Angeles County Coroner is investigating one of the deaths. And according to a spokesman at the California Department of Insurance, the agency has initiated an investigation into allegations of insurance fraud.

Dr. Mona Misra is a bariatric surgeon at L.A.’s Cedars Sinai Hospital. She says she’s glad regulators are looking into the practices, but Misra says many of her patients are getting the wrong message.

DR. MONA MISRA: For a lot of patients, the band might be the perfect operation for them and we don’t want them to be afraid of it because they think that this is such a dangerous operation.

KAHN: The Lap-Band is a small, surgically-implanted silicone ring that, when inflated, restricts part of the stomach so only a small amount of food can get in.

Democratic Congressman Henry Waxman, whose district covers much of Los Angeles, says he wants more regulatory oversight of the Lap-Band.

SENATOR HARRY WAXMAN: Here you have an outfit that’s putting up billboards urging people to get this Lap-Band product, and they’re not giving people all the information they’re entitled to have about the risks, the precautions, the possible side effects.

KAHN: The Food and Drug Administration recently sent a warning letter to the 1-800-GET-THIN marketers ordering them to include more prominent safety warnings. The group’s website now has disclaimers. But an FDA spokeswoman said the agency could not comment whether the marketers had fully complied with the warning. She would only say that firms are expected to correct violations, and failure to do so may result in enforcement action.

Those new disclaimers are too little and too late for Alexander Robertson. He’s a lawyer who has brought five different lawsuits, including two wrongful death claims against the 1-800-GET-THIN marketers and its affiliated surgeons.

ALEXANDER ROBERTSON: They really preyed on a very susceptible group of the population that obviously would like to look like those skinny, beautiful people on the billboards and were told this is a safe one hour procedure. You come in, you get it done and you are going to be thin right away.

KAHN: A lawyer for the surgical centers and others affiliated with 1-800-GET-THIN declined to be interviewed. But he did send a written statement denying all allegations against his clients and touted, quote, “the success we have achieved in improving the quality of life of thousands of patients.”

Meanwhile, for years Allergan, the manufacturer of the Lap-Band, continued selling the device to surgeons affiliated with the 1-800-GET-THIN campaign. Earlier this month, the company reversed that stance and announced they would no longer sell to Top Surgeons, Inc., which is affiliated with the controversial campaign. A spokeswoman for the company would not elaborate why the decision to halt sales was made.

Dr. Scott Cunneen, the head of bariatric surgery at Cedars Sinai, applauds the move. He and 29 other doctors recently sent a letter to members of Congress denouncing the approach to anti-obesity treatment used by the 1-800-GET-THIN surgical centers. Cunneen says he fears Congress will crack down on the use of the Lap-Band instead of monitoring surgeons who, he says, improperly use it.

DR. SCOTT CUNNEEN: We hope that Congress regulates the practices and the facilities in such a way that the safety is maintained and doesn’t, you know, condemn the whole category of therapy.

KAHN: Because Cunneen insists surgery, when performed properly and marketed truthfully, is the best and most effective way to combat obesity.

This week’s Real Estate stories

1329896899 68 This week’s Real Estate stories

Don’t miss these top stories:

  • Mortgage delinquencies, foreclosures fall

  • Foreclosure activity up 3% in January

  • Kiss these 10 once-popular home features goodbye

  • Housing crisis could play key role in election

If you were paying attention on Thursday, you saw two different stories about the housing market: The Mortgage Bankers Association said delinquencies and foreclosures fell in the fourth quarter of 2011 while RealtyTrac said foreclosure filings rose in January.

One simple way to account for the difference: They’re looking at different points in time. But it’s also worth noting that the reports are generated using two different methodologies.

The MBA receives its information from mortgage servicers when they initiate a legal action, said Jay Brinkmann, chief economist for the trade group. The survey covers 42.9 million loans on one- to four- unit residential properties, or about 88% of all first-lien residential mortgages in the country.

RealtyTrac data, on the other hand, is based on counts of foreclosure documents collected at the county level “though a nationwide network of data aggregators,” said Daren Blomquist, RealtyTrac’s vice president, in an email.

It’s also important to consider the sources of the reports: RealtyTrac’s business is to market foreclosure properties, while the MBA represents mortgage lenders.

Read about both measures in this week’s real-estate pages, plus read a Realty Q&A about the importance that housing will have on the presidential election.

RealtyTrac expects foreclosure volume to increase in coming months due to the recent foreclosure settlement between the government and the big banks, but Brinkmann said he isn’t sure that it will have a huge impact.

The health of the economy is likely a better predictor of foreclosure trends in the future, he said. “If we continue to see improvement in employment as we get into the spring buying season, the demand for houses we expect to be picking up,” Brinkmann said. If the housing market improves, it’s much easier for a homeowner to sell his home and avoid falling into foreclosure.

The unknown, however, is whether the economy will continue its recovery or if some other event — such as economic problems in Europe or $5 gas prices — will shake it from its course, Brinkmann said.

Monitoring of Muslim students sparks outrage

1329895691 65 Monitoring of Muslim students sparks outrage

Police talked with local authorities about professors 300 miles away in Buffalo and sent an undercover agent on a whitewater rafting trip in upstate New York, where he recorded students’ names and noted in police intelligence files how many times they prayed. Detectives trawled Muslim student websites every day and, although professors and students had not been accused of any wrongdoing, their names were recorded in reports prepared for Police Commissioner Raymond Kelly.

Yale President Richard Levin said the university’s police department did not participate in any monitoring by NYPD and was unaware of it.

“I am writing to state, in the strongest possible terms, that police surveillance based on religion, nationality, or peacefully expressed political opinions is antithetical to the values of Yale, the academic community, and the United States,” Levin said in a statement Monday.

A 2006 report explained that officers from the NYPD’s Cyber Intelligence unit visited the websites, blogs and forums of Muslim student associations as a “daily routine.” The universities included Yale; Columbia; Penn; Syracuse; Rutgers; New York University; Clarkson University; the State University of New York campuses in Buffalo, Albany, Stony Brook and Potsdam, N.Y.; Queens College, Baruch College, Brooklyn College and La Guardia Community College.

An NYPD spokesman said police wanted to get a better handle on what was occurring at student associations. He cited 12 people arrested or convicted on terrorism charges in the United States and abroad who had once been members of Muslim student associations, or MSAs.

NYPD spokesman Paul Browne said police monitored student websites and collected publicly available information, but did so only between 2006 and 2007.

“Students who advertised events or sent emails about regular events should not be worried about a ‘terrorism file’ being kept on them. NYPD only investigated persons who we had reasonable suspicion to believe might be involved in unlawful activities,” Browne said.

Faisal Hamid, a Muslim student leader at Yale, challenged the NYPD’s justification.

Van Halen 2012 Concert Tour Preview LA Forum Photos

1329893298 94 Van Halen 2012 Concert Tour Preview LA Forum PhotosA Review of David Lee Roth and Eddie Van Halen Rocking The Stage at a Private Friends and Family Show

Drop whatever you are doing and get tickets to the 2012 Van Halen concert tour.

Do so and you might as well “Jump.”

That’s because Van Halen rocks it, almost as they never left the stage. Several times during the show, and even more so afterward, you’re going to turn to friends and strangers and say just one word: “Wow. WOW!”

The legendary rock band has a five-month, 49-city tour in North America from February thru May and PubClub.com and the Bar Blogger were present as a special “friends and family” preview performance at the Forum in Los Angeles just prior to the first stop in Louisville. The were only a couple thousand people there for it, and as you can see from the photos we were right in front of the stage.

It was one of the few advance shows for the “A Different Kind of Truth,” tour, and it did feature a few songs off the new album, including one that’s already making traction with fans, “Tattoo.”

But it’s the band’s legendary songs that make the show sizzle, and if anyone is concerned that time has taken its toll on the members then set that fear aside, for some things remain completely unchanged.

Eddie Van Halen can flat-out play the guitar. The way Eli Manning can thread the needle to receivers in Super Bowls.

David Lee Roth, back for this tour and seeming to get along with Eddie as if they were brothers, may have stumbled a couple of words on occasion – even once admitting he forgot them – but his voice is Van Halen.

And that voice remains as solid as it did in the band’s heyday, and any doubts about this are wiped out when he blasts “Hot For Teacher.” It’s so true to the original you can shut your eyes and imagine you are watching the video with a hot blonde walking onto a platform in a blue bikini. Where, by the way, is a hot blonde walking onto a platform in a blue bikini?

It may take a few moments to actually recognize Roth. He doesn’t have the long, shaggy hair of the past. In fact, when he walked out on stage I actually thought he was Sting! “Cool,” I said, “Sting is introducing Van Halen.” But when he began to sing it was most definitely Roth.

Alex Van Halen never stops on the drums and while Michael Anthony is not on bass, Eddie’s son Wolfgang doesn’t miss a beat.

There are a few signs of age. The show isn’t flamboyant as in the past.  Roth doesn’t jump up with outstretched legs in tight striped pants and the band doesn’t swing from a cable during “Panama.” But Eddie does the signature foot shuffle from the video days. And Roth dons all manner of eye-catching clothes. He also slides a lot; they actually put in a special floor for that after the warm-up band which, by the way, is Kool & The Gang (more on that later).

There’s no shortage of the classic songs in the show: “Running With The Devil,” Dance The Night Away” and “Ice Cream Man.” It’s all vintage Van Halen, yet its live and it’s today. And it still rocks. WOW!

As previously mentioned, the show opens with Kool & The Gang. That might seem a bit odd, a contrast of styles, but they are really good, too.

And that makes the entire night a reason to “Celebrate.”
